Belleville man sues over alleged injuries after falling in hole

BELLEVILLE - A Belleville man is suing the city, a water company and other parties, saying he was injured when he fell in a hole.

Mike Pacheco filed the complaint in the St. Clair County Circuit Court against the City of Belleville, Stookey Township, Illinois-American Water Company and Patrick Brym. 

Pacheco claims he was walking in a lawn owned by Brym on Woodcliffe Drive when he took a step and allegedly tripped in a hole he claims was created by one of the defendants. As a result, the plaintiff claims he suffered injuries to his shoulders and hips. 

Brym "had a duty to maintain this property," the suit states. "Defendant Brynn failed to cover the hole or warn of any potential danger. Defendant Brym had a duty to all residents, including Plaintiff, to use reasonable and ordinary care to prevent injury to residents as the result of dangerous conditions it created on Woodcliffe Drive. Defendant Brym knew, or should have known, by using ordinary care of the condition of the hole."

Pecheco claims he will continue to experience pain and suffering and has incurred medical expenses. 

The plaintiff seeks more than $50,000 from each of the defendants. He is represented by Andrew Toennies of Kirkendall Dwyer LLP in St. Louis.
