EDWARDSVILLE – A hotel guest is suing after she was allegedly attacked by a dog at a Super 8 Hotel in Alton.
Plaintiff Divine Thomas filed the lawsuit in the Madison County Circuit Court against Nicole A. McCane, Shondalynn Yvette Lunsford, Super 8 Worldwide, Inc, Wyndham Hotels and Resorts LLC, doing business as Super 8 by Wyndham Alton, and Shivam Hotel, LLC, doing business as Super 8, citing negligence in violation of the state's Animal Control Act.
According to the lawsuit, the plaintiff was a guest at the Super 8 Hotel in Alton on April 9. She claims she was walking down the hallway when she was suddenly and without warning attacked by a German Shephard that was owned by McCane, who was also a patron of the hotel.
The lawsuit claims that under the Illinois Control Act, the owner of the dog is liable for injuries caused by the animal.
Lunsford is the owner and operator of the Super 8 Hotel where the incident took place. Lunsford, Super 8 and the other defendants have been named in the lawsuit for allegedly negligently failing to take measures to protect the safety of its patrons and guests.
Thomas claims she has suffered permanent disabling injuries, disfigurement, pain and suffering as a result of the attack. She also alleges the attack has caused her to lose wages and will affect her ability to earn income and enjoy normal life in the future. The lawsuit states that Thomas has incurred medical expenses and will continue to require the services of medical staff to recover.
The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorney Rodney D. Caffey of The Caffey Law Firm, LLC in Godfrey.
