BELLEVILLE – A woman is suing a Belleville homeowner after she allegedly slipped and seriously injured herself on the front deck.
Plaintiffs Tara and Mark Szymanski filed a lawsuit in the St. Clair County Circuit Court against defendant David Mitts, citing negligence and carelessness.
According to the lawsuit, Tara Szymanski was a guest at Mitts' property in Belleville on April 12. She claims she allegedly slipped on moss that had grown on his front deck. She alleges that Mitts failed to properly maintain the premises and take proper precautions to protect the safety of his guests.
Szymanski allegedly suffered serious injuries, which have caused her to experience pain and suffering, lost wages and will affect her ability to earn income in the future. She adds that she has incurred medical expenses and will continue to require the services of medical staff to recover.
Mark Szymanski alleges that as a result of the incident, he has been deprived of his wife's consortium and support.
The plaintiffs are seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. They are represented in this case by the attorneys of Rich, Rich, Cooksey & Chappell, P.C. in Fairview Heights.
