BELLEVILLE – A patron is suing Pops Nightclub Concert Venue in Sauget after she was allegedly assaulted with a handgun as she was leaving the building.
Plaintiff Amanda Talley filed the lawsuit in the St. Clair County Circuit Court against Mississippi Av. Inc. doing business as Pops Nightclub Concert Venue, citing carelessness and negligence.
According to the lawsuit, the plaintiff was a patron at Pops Nightclub Concert Venue on Jan. 14. While she was on the premises with her friends, she claims that two women at the venue got into an altercation near closing time at 6 a.m. and were asked to leave the club.
Talley alleges that as the club closed and she was leaving the premises, she was assaulted by one of the women from the earlier altercation and one of woman's male companions. She claims the male hit her in the head with a handgun, causing her serious and permanent injuries.
The lawsuit states that the defendants were negligent in failing to provide a safe area for patrons to exit the premises, failing to provide security personnel at the exits, and failing to take measures to protect patrons from the individuals who were involved in the initial conflict.
Talley claims that as a result of the assault, she has suffered fractured bones in her face and jaw. She alleges her injuries have caused her to lose wages in the approximate amount of $5,000 and will impact her ability to enjoy normal life in the future. She adds that her injuries have caused her to incur $16,000 in medical expenses and that she will require further medical treatment in the future to recover from her injuries.
The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Thomas G. Kemper of Butler & Kemper in Hillsboro, Mo.
