EDWARDSVILLE – A woman claims she was using a lash curler purchased at Walmart when the tension bar malfunctioned and injured her eye.
Plaintiff Marbella Calderon filed the lawsuit in the Madison County Circuit Court against Hard Candy, LLC and Walmart, Inc., citing negligence and product liability.
According to the lawsuit, the plaintiff bought a Hard Candy X Marilyn Monroe Lash Shape and Curl lash curler from a Walmart located in Granite City. She alleges that on Aug. 7, 2021, she was using the product for its intended use and properly followed the provided instructions. She claims that while she was squeezing the curler's handles, the tension bar on the device snapped and drove a sharp piece of metal into her eye, which required emergency medical treatment.
The lawsuit states that the lash curler is defectively designed in such a way that the tension bar is located beneath the central axis, which has a clear trajectory towards the eye in case of a malfunction. The lawsuit also states that the device was constructed of substandard materials that couldn't reliably undergo the application of normal pressure.
Calderon claims she has suffered severe injuries to her left eye. She states that she has suffered a permanent decrease in vision, pain, suffering and mental anguish. She adds that the injury has forced her to incur substantial medical costs.
Walmart is named in the lawsuit for failing to notify customers of the potential danger of the product.
The plaintiff is seeking damages in excess of $50,000 and any other relief the court deems proper. She is represented in this case by attorneys John G. Simon and Elizabeth S. Lenivy of The Simon Law Firm, P.C. and Gonzalo Fernandez of Fernandez Law, LLC in St. Louis.
