Man sues neighboring Meadowbrook Intermediate School for causing property to flood

EDWARDSVILLE – A Moro property owner is suing the Bethalto school district, claiming modifications made to Meadowbrook Intermediate School have disrupted waterflow and caused his property to flood. 

Plaintiff David Paslay filed the lawsuit in the Madison County Circuit Court against the Bethalto Community Unit School District.

According to the lawsuit, the plaintiff owns a property adjacent to the Meadowbrook Intermediate School in Moro. Paslay alleges that beginning in 2003 and continuing through 2020, the defendant modified the school property by increasing the size of the buildings, playground area and parking lot, which reduced soil porosity and caused the property to retain more rainwater. The plaintiff also adds that the school installed a drainage pipe that empties rainwater onto his property without adequate drainage elevation.

As a result of these modifications, the defendant has increased the amount and rate of flow of surface water onto Paslay's property, at times flooding it. 

Paslay is requesting the court to order the defendant to take corrective action to decrease or divert the flow of water so as to stop damaging his property. He is also seeking damages in excess of $50,000, plus court costs. He is represented in this case by attorney Steven M. Wallace, of Goldenberg Heller & Antognoli, P.C. in Edwardsville.
