EDWARDSVILLE – A visitor at the Roxana Community pool claims she slipped and fell in the pool's shower because the flooring did not have any anti-slip measures installed.
Plaintiff Desiree Hutton filed the lawsuit in the Madison County Circuit Court against defendants Wells Painting and Pressure Washing, LLC, Gregory Wells, doing business as Wells Painting and Pressure Washing, Roxana Community Park District and the Village of Roxana.
According to the lawsuit, Hutton was at the Roxana Community pool on Aug. 14, 2021. Hutton claims she was using the women's shower on the premises when she slipped and fell, injuring herself. The plaintiff alleges the shower did not have any slip resistant measures put in place, which created a dangerous condition.
Hutton alleges Wells and Wells Painting and Pressure Washing was hired by the Roxana Community Park District and the Village of Roxana to remove the previous flooring of the showers and apply a new surface. The defendants allegedly failed to install anti-slip measures after they put the new shower flooring in.
Hutton claims her injuries have caused her to endure pain, suffering and mental anguish. She also claims that her injuries have affected her ability to lead a normal life and earn income. The lawsuit states that Hutton has incurred medical expenses and will continue to require the services of medical staff to recover.
The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorneys Michael P. Glisson and Timothy J. Chartrand of Williamson, Webster, Falb, & Glisson in Alton.
