Suit alleges nursing home resident suffered from urinary tract infections, sepsis prior to death

BELLEVILLE – A wrongful death suit alleges a resident at the Four Fountains nursing and rehabilitation center received negligent care prior to her death.

Plaintiff Courtney Speed, acting as independent administrator of the estate of Annie Callahan, filed a lawsuit in the St. Clair County Circuit Court against Helia Healthcare of Belleville, LLC doing business as Four Fountains and CEP America, LLC, doing business as Vituity, citing negligence in violation of the state's Nursing Home Care Act.

According to the lawsuit, Callahan was a patient in the care of the Four Fountains nursing and rehabilitation facility, which contracted nurses and medical staff from CEP America. The lawsuit states that Callahan had been at the facility for several years and suffered from various urinary tract infections during her stay at the facility. 

On Sept. 3, 2020, Callahan was taken to the hospital with a urinary tract infection, bacteremia, sepsis and other related conditions. Speed claims Callahan's injuries lead to her death three days later. 

According to the lawsuit, Callahan died as a result of the defendants' negligence and carelessness. The plaintiff alleges the defendants violated the state's Nursing Home Care Act by negligently failing to provide sufficient care and staff to safely meet the specific personal needs of Callahan. The plaintiff alleges Callahan's death has caused grief and sorrow to her next of kin. 

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorneys Robert P. Marcus and Sara Salger of The Gori Law Firm, P.C. in Edwardsville.
