Norfolk Southern Railway worker sues over alleged exposure to toxic fumes on the job

BELLEVILLE – A railroad employee claims he was exposed to toxic chemicals on the job, causing him to develop cancer. 

Plaintiff Kenneth Sumner filed a lawsuit in the St. Clair County Circuit Court against Norfolk Southern Railway Company, citing negligence.

According to the lawsuit, Sumner was employed by Norfolk Southern Railway Company as a machine operator. Sumner states that during his employment with the defendant, he was required to work in environments which caused him to be exposed to toxic chemicals. Sumner adds that the company did not issue him proper equipment to protect him from exposure.

Sumner states that as a result of his exposure, he contracted lung cancer. 

The plaintiff is demanding a trial jury to seek damages for his injuries and incurred medical costs. He is represented in this case by attorney Patrick S. O'Brien of the Law Offices of Patrick S. O'Brien, LLC and and Benjamin R. Schmickle of SWMW Law.
