BELLEVILLE – A cyclist is suing a Mascoutah resident after his dog allegedly attacked her without provocation.
Plaintiff Melody Evans filed the lawsuit in the St. Clair County Circuit Court against defendant Nathan Brammer, citing negligence in violation of the state's Animal Control Act.
According to the lawsuit, Evans was riding her bicycle on a public street in Mascoutah near the defendant's residence on July 19, 2021. Evans claims Brammer's pit bull suddenly and without warning attacked her, knocking her off her bicycle and causing her to sustain serious injuries. The lawsuit states that under the Illinois Control Act, the owner of the dog is liable for injuries caused by the animal.
The plaintiff claims her injuries have caused her to endure pain and suffering and will affected her ability to earn income and enjoy normal life. The plaintiff also alleges that she has incurred medical expenses.
Evans is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by the attorneys of The Simon Law Firm, LLC in St. Louis.
