BELLEVILLE – An Illinois Central Railroad Company employee has filed a negligence lawsuit against his employer after he was allegedly struck with a branch while operating a locomotive.

Plaintiff Greg Irwin filed a lawsuit in the St. Clair County Circuit Court against Illinois Central Railroad Company, citing negligence.

According to the lawsuit, Irwin was employed by the defendant as a locomotive operator. Irwin alleges that while he was carrying out his duties on Aug. 4, 2020, a tree branch suddenly crashed into the cab of the locomotive, striking him and causing him to suffer injuries. Irwin claims the defendant was negligent in not keeping the rail line free of dangerous tree branches which led to his injury.

Irwin states that as a result of his injuries, he has endured pain, suffering, disfigurement and disability. He claims his injuries will affect his ability to earn income and enjoy life in the future.

Irwin also claims his injuries will require extensive medical treatment, which has caused him to incur medical expenses. He claims he will continue to require the services of medical staff to recover. 

The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. He is represented in this case by attorney John P. Kujawski of Kujawski & Associates, LLC in O'Fallon.
