EDWARDSVILLE – A man filed a breach of contract lawsuit against a Collinsville contractor, claiming his pole barn had to be restarted due to shoddy construction work.
Plaintiff David Mears filed the lawsuit in the Madison County Circuit Court against defendant Robert Sloan, citing breach of contract and negligence.
According to the lawsuit, on Dec. 20, 2021, the plaintiff entered into a contract where the defendant would supply labor and materials for concrete work on the plaintiff's pole barn in St. Jacob. The plaintiff claims the defendant poured frost fittings and stem walls for the barn in December 2021. He then allegedly began installing roof trusses and walls for the structure.
The suit states that in March 2022, the roof trusses fell due to negligent construction and damaged the foundation walls, which required demolishing the structure and restarting the project.
Mears claims he had already paid $40,000 before the project began with the remainder to be paid upon completion of the project. He claims demolishing the building to restart the project caused him to incur damages in excess of $50,000.
The plaintiff is seeking damages in excess of $50,000 and any other relief the court deems proper. He is represented in this case by attorney Holly A. Marcum of Keith Short and Associates, P.C. in Alton.
