Railroad employee allegedly given improper equipment, causing injuries

BELLEVILLE – An Illinois Central Railroad Company employee claims he was injured on the job after being issued improper equipment and instructed to carry anchor bags without help. 

Plaintiff Kevin L. Nelms filed a lawsuit in the St. Clair County Circuit Court against the Canadian National Railway Company and its subsidiary Illinois Central Railroad Company, citing negligence and carelessness.

According to the lawsuit, Nelms was employed by Illinois Central to do maintenance and mechanical work. He claims that on Dec. 9, 2019, he was working with improper tools and equipment at a time when the company was shorthanded. Nelms alleges he was injured on the job when he was forced to carry anchor bags by himself. He claims the defendants failed to provide him suitable tools and equipment to do his assigned tasks safely. 

Nelms claims he has sustained injuries that have caused him pain, suffering and mental anguish. He alleges his injuries will affect his earnings and his ability to earn income and enjoy life in the future. He also alleges his injuries have caused him to incur medical expenses and he will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Benjamin P. Tobin of Pratt & Tobin, P.C. in East Alton.
