Davita Healthcare Partners in O'Fallon named in wrongful termination lawsuit

BELLEVILLE – A former employee of Davita Healthcare Partners is suing for wrongful termination after he was allegedly fired for reporting staffing shortages and improper billing practices. 

Plaintiff Adam J. Quitmeyer filed a lawsuit in the St. Clair County Circuit Court against defendants Davita Healthcare Partners, Inc, Total Renal Care, Inc., and Rochelle Stockman, citing negligence, wanton misconduct, violations of the Illinois Wage Payment and Collection Act, and wrongful termination in violation of the Illinois Whistleblower Act.

According to the lawsuit, Quitmeyer was employed by the defendant as a nurse from Aug. 3, 2020, until he was allegedly fired without reason on March 15, 2022. During his employment, he was under the direct supervision of Stockman.

The plaintiff claims that approximately one month before his termination, he filed a report with management to complain about insufficient staffing ratios, which he alleges was putting the safety of the patients at risk. The suit states that due to the insufficient staffing situation, Quitmeyer worked average shifts of 14-16 hours and once worked a 22-hour shift.

He also reported alleged improper billing practices. He claims the defendant failed to fairly compensate him proper overtime pay in violation of the Illinois Wage Payment and Collection Act. 

According to the lawsuit, the plaintiff alleges that he was wrongfully terminated in retaliation for his report in violation of the Illinois Whistleblower Act. 

The plaintiff is seeking damages in excess of $50,000, plus court costs, punitive damages, and any other relief the court deems proper. He is represented in this case by the attorneys of Wendler & Zinzilieta, P.C. in Edwardsville.
