BELLEVILLE - The operators of several adult night clubs are being sued for allegedly violating the Illinois Biometric Information Privacy Act by allegedly collecting and storing customers' biometric information without written consent.
Jacob Kline and Hasan Agicic filed the lawsuit in the St. Clair County Circuit Court against Family Dog LLC, HWL-3 LLLP, VCG Holding Corporation, Illinois Restaurant Concepts LLC and MRC LLC.
According to the complaint, the defendants operate adult entertainment night clubs, including Roxy's Brooklyn, PT's Brooklyn, PT's Centreville, Country Rock Cabaret, Penthouse and Diamond Cabaret.

The plaintiffs claim the defendants collected biometric information and associated the date "with their customers other personal identifying information, such as name and address."
"Defendants did not inform in writing either plaintiffs or class members that their biometric data was being recorded, obtained, collected, and/or stored," the suit states." Defendants did not obtain plaintiffs' or class members' written consent to record, collect, obtain, and/or store Plaintiffs' and class members' biometric data."
The plaintiffs claims the defendants "failed to store class member's data using the reasonable standard of care within its industry and/or in a manner that is the same as or more protective than the manner in which they store, transmit, and protect other confidential and sensitive information."
The plaintiffs seek $5,000 in damages for each "willful" violation of the law and $1,000 or each violation caused by negligence. They are represented by William Beaumont of Beaumont Costales LLC in Chicago.
