Shopper sues Target after allegedly stepping in pothole at Belleville store

BELLEVILLE - A Millstadt woman is suing Target, claiming she was injured when she stepped into a pothole in front of the Belleville store.

Jane Demick filed the complaint in the St. Clair County Circuit Court against Target Corporation.

According to the complaint, Demick was at the Belleville store on Nov. 8, 2020, between approximately 5 p.m. and 6 p.m. She claims she was walking to her car in the parking lot located in front of Target when she allegedly stepped in a pothole, causing her to fall.

As a result, the plaintiff claims he suffered injuries and has incurred medical expenses. 

Demick alleges the defendant knew that the parking lot was in an uneven, broken, unkept condition "for some time" and allowed the condition to remain. She also alleges Target failed to provide a safe means of ingress and egress and failing to warn of the hazardous condition. 

"It was the duty of the Defendant, Target Corporation, to exercise reasonable care and caution in and about the maintenance of the parking lot, and to keep the same in a safe condition for the Plaintiff and for other persons lawfully using the parking," the suit states

Demick seeks a judgment in excess of $50,000, plus costs and all other relief the court deems just. She is represented by attorney John Pawloski of the Law Office of Van-Lear P. Eckert PC in Belleville.
