BELLEVILLE - A St. Clair County man has sued AutoZone after he allegedly tripped in the parking lot of a store on East Highway 50 in O'Fallon.
Jerry Moore filed the lawsuit in the St. Clair County Circuit Court, alleging he "tripped and fell as a result of a trip hazard on the curb in front of the store that Plaintiff did not know was there and had no reason to know was there."
The suit states that the curb was uneven and was not painted yellow in order to provide a warning. Moore also alleges the curb was hidden from view by the presence of other cars and red barriers that plaintiff had to avoid."
Moore alleges AutoZone "negligently and carelessly allowed an uneven curb to be allowed in the front of the store that patrons had to encounter to get in the store."
Moore "has suffered, and will suffer in the future, severe injury and pain, lost enjoyment of life, disability, and pain and suffering as a result of defendant's negligence," the lawsuit claims.
Moore seeks more than $50,000 in damages, plus legal costs. He is represented by attorney Matthew Young of Kuehn Beasley & Young PC in Belleville.
