Suit alleges Shiloh assisted living facility failed to assist wheelchair-bound resident

BELLEVILLE - An assisted living complex in Shiloh is accused of negligence after one of its residents allegedly fell and suffered injuries. 

The complaint was filed by plaintiff Sandra Galik in the St. Clair County Circuit Court against Morningside of Shiloh.

According to the complaint, Galik claims she was a resident at the facility located at 1201 Hartman Ln. in Shiloh. Galik claims she had been staying at the facility for just three days when she fell on July 18, 2020, after an employee allegedly failed to properly assist her while moving from her wheelchair to the toilet. 

After sustaining injuries during the fall, Galik was transported to a hospital for treatment and then ordered not return to Morningside by her physician. Galik alleges she had to move to a substantially more expensive skilled nursing home after the fall. 

The facility is owned and operated by defendants FVE Managers Inc. and SNH Lincoln Tenant LLC. 

The defendants are accused of one count each of common law negligence, one statutory claim for neglect and abuse pursuant to Illinois Assisted Living and Shared Housing Establishment Code, and one count of negligence per se. Galik demands at least $50,000 in civil penalties for each count. 

The plaintiff is represented by the Law Office of Stephen C. Buser, LTD, of Columbia and Kevin Boyne, Attorney at Law, of Belleville.
