EDWARDSVILLE – A couple is suing Allstate Fire and Casualty Insurance Company, alleging the company is in breach of contract for refusing to pay for underinsured motorist coverage following a collision.
Plaintiffs Dennis Warren and Sandra Warren filed the lawsuit in the Madison County Circuit Court against defendant Allstate Fire and Casualty Insurance Company, citing breach of contract.
According to the lawsuit, the plaintiffs claim they had an insurance policy with the defendant, which included underinsured motorists' (UIM) bodily injury coverage and limits of $100,000 per person. The suit states that the policy was effective on June 13, 2020, when the Warrens were in an automobile collision with Jaime Frey, a driver that was also insured by the defendant. The plaintiffs claim they successfully filed a lawsuit against Frey, which resulted in a settlement that was approved by the defendant. According to the lawsuit, Frey's policy paid $50,000 per person ($100,000 total).
The plaintiffs claim that following the settlement, they applied for coverage under their UIM coverage, but Allstate has breached the terms of its policy by failing to provide any such UIM coverage.
The plaintiffs are seeking damages in excess of $50,000, plus interest, attorney fees, court costs and any other relief the court deems proper. They are represented in this case by attorney Brian M. Wendler of Wendler and Zinzilieta, P.C. in Edwardsville.
