EDWARDSVILLE – A UPS delivery driver is suing the owners of a dog, following an alleged attack in Edwardsville.
Plaintiff Toby Gvillo filed the lawsuit in the Madison County Circuit Court against defendant Jeff Hasty, citing negligence in violation of the state's Animal Control Act.
According to the lawsuit, Gvillo was employed with UPS to drive a delivery truck and deliver packages. Gvillo claims that on April 9, 2020, he was delivering a package to a residence in Edwardsville when the defendant's dog suddenly attacked him without provocation. He claims the incident caused him to suffer psychological trauma and physical injury to his right arm, right hand, and body.
The lawsuit claims that under the Illinois Control Act, the owner of the dog is liable for injuries caused by the animal.
Gvillo claims he has suffered "severe and permanent psychological and bodily injury, pain and suffering, disability, loss of a normal life and disfigurement," which will affect his ability to earn income. The lawsuit states that Gvillo has incurred medical expenses and will continue to require the services of medical staff to recover.
The plaintiff is seeking damages in excess of $50,000, plus court costs. He is represented in this case by attorney Zachary W. Tobin of Pratt & Tobin, P.C. in East Alton.
