Motorist allegedly hit concrete pole to avoid another driver

EDWARDSVILLE - A driver is suing another motorist for allegedly turning in front of him in Edwardsville, causing him to swerve his vehicle and run into a concrete pole. 

Plaintiff Blake. A Harper filed the lawsuit in the Madison County Circuit Court against defendant Nicholas R. Ibanes-Ivester, citing negligence and carelessness. 

According to the lawsuit, Harper was traveling eastbound on New Poag Road near its intersection with Stadium Drive. Harper claims the defendant was driving in the opposite direction on the same road at the time and allegedly made a left turn directly in front of Harper's vehicle. The plaintiff claims he swerved to avoid Ibanes-Ivester's vehicle. As a result of his evasive action, he ran onto nearby grass and struck a concrete pole, damaging his vehicle and injuring to himself.

The lawsuit states that Harper suffered "serious and permanent" injuries to his right shoulder which required surgery. Harper claims he has endured "great physical pain and mental anguish," and that his injuries will impair his ability to earn income and enjoy regular activities. The lawsuit states that Harper has incurred medical expenses as a result of the collision and will continue to require the services of medical staff to recover. 

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Tonya Genovese of The Gori Law Firm in Edwardsville.
