EAST ST. LOUIS - A professional photographer from Atlanta is suing Prism Restoration and its founder for allegedly using his photographs in advertisements without permission.
Gary C. Gomez filed a lawsuit in the U.S. District Court for the Southern District of Illinois against Prism Restoration, LLC and its founder Chris Luebbers, citing copyright infringement.
According to the lawsuit, Gomez is a professional photographer and claims the defendants used his intellectual property without permission to promote their residential remodeling services on the internet.
The plaintiff claims he contacted the defendants to resolve the matter, but that the defendants have failed to respond.
Gomez is demanding that the defendants pay an amount equivalent to actual damages and profits gained from the copyright infringement along with court costs, attorney fees and any other relief the court deems proper. He is represented in this case by attorney Joel B. Rothman of Sriplaw, P.A. in Boca Raton, Fla.
