Legal malpractice suit alleges attorney failed to file personal injury claim by deadline

BELLEVILLE — A man claims his attorney failed to file a personal injury complaint involving a rear-end collision prior to the statue of limitation deadline. 

Jeffrey Gering filed a complaint in the St. Clair County Circuit Court against Gary Burger and Burger Law LLC, alleging legal malpractice. 

According to Gering's suit, he suffered back and neck injuries on April 19, 2019 when his vehicle was struck in the rear by a truck. He hired Burger to represent him in his personal injury case. He alleges Burger failed to recognize the statue of limitation, which was set to expire on April 19, 2020. He alleges Burger also failed to take any action to preserve his potential claim.

Gering alleges that had it not been for Burger's violation of his duty, he would have filed his claim in a timely manner and received compensation for his injuries. Gering further alleges that as a result of Burger's actions, he has lost wages and incurred medical treatment expenses. 

Gering seeks compensation of more than $1 million and all other just relief. He is represented by George Ripplinger of Ripplinger & Zimmer LLC in Belleville.
