BELLEVILLE — The mother of a boy who suffered life-threatening injuries when an ATV landed on top of him claims minors should not have been allowed to ride the vehicle unsupervised.
Angela M. Ware, as mother and next of friend of G.W., a minor filed a complaint in the St. Clair County Circuit Court against 3R Farms LLC and John/Jane Doe, alleging negligence.
According to the complaint, Jane Doe, a minor, G.W., and another child were at 3R Farms on April 2. The plaintiffs claim that an employee of 3R Farms turned over the key and possession of an ATV to Doe. The other minors were allowed to seat themselves at the front of the vehicle where no seat existed to support G.W. or no seat belt. Ware claims Doe drove the vehicle at a high rate of speed down a driveway, lost control and caused the ATV to flip into the air, ejecting G.W. Ware claims the ATV landed on top of G.W, which caused the minor to suffer life-threatening injuries, including a severe brain bleed and collapsed lungs.
Ware alleges the defendants were negligent for allowing a 15-year old to take possession of the ATV, for failing to prevent the minors from riding the vehicle and for not supervising, educating or warning Doe of the dangers associated with the ATV. She also claims 3R Farms failed to prevent the improper seating of the minors.
The plaintiffs seek monetary relief of more than $50,000 and all other just relief. They are represented by Rhonda Fiss of The Law Office of Rhonda D. Fiss PC in Belleville.
