EDWARDSVILLE — The passenger in a vehicle traveling on New Poag Road in South Roxana claims the driver was under the influence of marijuana when he collided with another driver.
Emily Mattingly filed a complaint on April 22 in the Madison County Circuit Court against Carly Caldwell and Brett Jackson, alleging negligence.
According to the complaint, Mattingly was a passenger in a Volkswagen Passat that was being driven by Jackson on May 8, 2021. They were traveling on New Poag Road in South Roxana. Mattingly alleges Caldwell was driving her Nissan Versa eastbound. While attempting to make a left turn onto Illinois Route 111, Caldwell allegedly collided with the Volkswagen. Mattingly claims Jackson was driving while under the influence of "an intoxicant including but not limited to marijuana."
Mattingly claims that as a result of the collision, she suffered injuries to her chest, collar bone, back ribs and other parts of her body.
She alleges Jackson was speeding and failed to warn of the crash or try to maneuver to avoid an impending collision. Mattingly also claims Caldwell negligently failed to yield the right of way, was driving while distracted and driving at an unsafe speed. She further claims Caldwell failed to stop at a traffic signal or maneuver to avoid the collision.
Mattingly seeks monetary relief of more than $50,000, plus interest and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster, Falb & Glisson in Alton.
