Woman delivering ice cream sues over trip, fall at Collinsville apartment

EDWARDSVILLE — A woman claims she tripped and fell at a Collinsville apartment while delivering ice cream. 

Alyssa Jolly filed a complaint on April 20 in the Madison County Circuit Court against Lerch Properties Enterprises LLC and Lerch Properties LLC, alleging negligence. 

Jolly claims in her suit that she was delivering ice cream to a tenant at the defendants' property on Skyline Drive in Collinsville on April 8, 2021. She claims she suffered injuries to her ankles and foot after tripping over an "unmarked change in height elevation" on the walkway. 

Jolly alleges the defendants are negligent for failing to inspect the property and mat, failing to maintain its walkways and failing to warn of the hazard when they knew or should have known of the dangerous condition. She also alleges the defendants failed to operate and maintain their premises in accordance with local and federal safety guidelines, laws and codes. 

Additionally, Jolly claims the defendants did not train their employees to prevent or remedy the dangerous condition, which caused her fall. 

As a result, she claims she suffered lost wages and incurred medical treatment expenses. 

Jolly seeks more than $50,000, interest and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster Falb & Glisson in Alton.
