Woman suing Granite City apartment complex over trip, fall on cracked asphalt

EDWARDSVILLE — A woman is suing the owners of an apartment complex after she allegedly tripped on an uneven walkway. 

Marsha Acord filed a lawsuit on March 25 against Birkenmeyer Properties LLC, alleging negligence. 

Acord claims that the landlord of the complex did not maintain the facility's asphalt walkways, causing the asphalt to become cracked. As a result, the plaintiff claims she fell and suffered injuries to her shoulder, knee, neck, lower back and spine. Acord claims the defendant's alleged negligence was in violation of city ordinance.

These injuries have caused Acord to lose her previous livelihood and created additional costs for her. Acord also claims she endured pain and suffering and an inability to live a "normal life" as a result of the injuries. 

The owner of the apartment is being included as a defendant in the lawsuit for allegedly having the responsibility to maintain the premises. Acord claims that the owner was made aware of the situation and did nothing to alter it. 

Acord claims that a barricade should have been put in place protecting residents from the cracked and uneven part of the walkway. 

The plaintiff seeks a judgment in excess of $50,000. She is represented by Robert Marcus of The Gori Law Firm PC in Edwardsville.
