Woman alleges insurer failed to pay fire claim, breaching contract

EDWARDSVILLE - A woman claims Allstate Insurance has failed to provide payments following a fire. 

Mary Ella Chapman filed a lawsuit in the Madison County Circuit Court against Allstate Insurance Company, alleging breach of contract. 

According to the lawsuit, on April 3, 2017, Chapman's premises was damaged due to a fire. She provided Allstate with a prompt notice of the loss and demanded the insurer pay for the losses pursuant to her contract of insurance. As of the date of loss, plaintiff had fully paid all premiums required by the contract. However, she claims Allstate has failed and refuses to pay damages related to Chapman's claim. 

Chapman alleges Allstate owes her a contractual duty of good faith and fair dealing in handling the insurance claim.

The plaintiff claims she was caused to suffer damages including the loss of contractual policy proceeds and emotional distress related to the alleged wrongful withholding of contractual proceeds.

Chapman seeks a sum in excess of $50,000 and cost of suit. She is represented by Rodney D. Caffey of The Caffey Law Firm LLC in Godfrey.
