Man allegedly knocked unconscious when shipping container lid slid off

EDWARDSVILLE - A man claims he suffered severe injuries when a container lid slid off the chassis and caused him to fall out of the yard dog he was operating, knocking him unconscious. 

Richard Landert filed a lawsuit on Feb. 28 in the Madison County Circuit Court against Red Bird Carriers, Inc., Superior Hauling and Fast Transit, Inc. doing business as Red Bird Carriers and Fastrack Auto Transportation and Hogan Truck Leasing, Inc. doing business as Hogan Motor Leasing, Inc., alleging negligence.

According to the lawsuit, the defendants delivered a shipping container and a chassis to DB Schenker’s yard in Edwardsville on March 25, 2021. Landert was operating a yard dog to move the chassis and container when the container lid slid off the chassis, causing the yard dog’s cab to violently bounce up and down on the ground multiple times. Landert claims his face slammed into the steering wheel, and he was thrown backwards out of his seat and cab through the yard dog's rear door. He landed on the catwalk behind the cab once the bouncing stopped and was knocked unconscious. 

The plaintiff alleges the defendants were negligent in failing to fix or replace a broken door or the yard dog equipment in its entirety. 

Landert claims he was caused to suffer physical injuries to his head, brain, face, neck, shoulder, back and body as a whole; will continue to require medical treatment; endured pain and suffering of the mind and body that will continue causing significant pain permanently; incurred medical expenses; lost wages; benefits and earning capacity ability; and suffered significant disability and future damages.

Landert seeks an amount in excess of $50,000, plus post-judgment interest and court costs. He is represented by Richard J. Zalasky of Brown & Crouppen PC in St. Louis.
