EAST ST. LOUIS - A freight truck driver claims another motorist ran a stop sign and caused the plaintiff's vehicle to overturn.
Tremaybe Dean Tarpley filed a federal lawsuit on Feb. 23 in the U.S. District Court for the Southern District of Illinois against Keith Kibler, special administrator of the estate of Gerald W. Morris, deceased, alleging negligence.
According to the lawsuit, on June 25, 2020, Morris drove his vehicle past a stop sign at the intersection of Illinois Route 13 and Paulton Road in Williamson County and drove into the lane occupied by a 2020 freight truck operated by Tarpley. The collision allegedly caused Tarpley's vehicle to overturn and resulted in injuries.
Tarpley alleges Morris was negligent in failing to obey a stop sign, failing to yield right-of-way, failing to decrease speed to avoid a crash, failing to keep his vehicle under proper control and failing to keep proper lookout.
Tarpley was allegedly caused to suffer medical expenses, pain, suffering, disability, disfigurement and increased risk of future harm.
Tarpley seeks a judgment against the estate, plus cost of suit. The plaintiff is represented by Stephen W. Stone of Howerton Dorris Stone & Lambert in Marion.
