Trustee holder sued for allegedly withholding funds from recipient

EDWARDSVILLE - A man claims the trustee of a family trust spent all of the money and failed to distribute his portion of the funds. 

David E. Watson filed a lawsuit on Feb. 16 in the Madison County Circuit Court against Marcia L. Watson, individually and as Trustee of the Declaration of Trust dated March 3, 2015.

According to the lawsuit, Malea Watson, also known as Malea Hagen, is a trustee for the defendant trust. David Watson claims he is entitled to his share being distributed to him as he is not on government assistance other than social security and Medicare payments, per the terms of the trust. David Watson claims he requested his share of the trust to be distributed to him, but the trustee has refused. He claims the defendant should have several hundred thousand dollars of his money and has a fiduciary duty to provide his portion of the trust. 

David Watson also claims the defendant is in violation of duty after allegedly spending the trust assets on personal matters of the trustee and failing to remit the amount.

Watson seeks an amount in excess of $50,000, plus treble punitive damages, costs and attorney fees. Watson is represented by Thomas G. Maag of Maag Law Firm LLC in Wood River.
