Polsinelli PC issued the following announcement on Feb. 8.

The Intellectual Property Department of Am Law 100 firm Polsinelli has been recognized in three of Juristat’s 2021 reports. The firm was noted for having one of the best track records against difficult examiners, ranking No. 4 on the list of firms that most often prosecute in front of difficult examiners and has been named one of the Top Patent Firms in 2021.

“The fact that we are considered a top patent firm and consistently achieving success working with difficult examiners is a testament to our highly experienced attorneys and our best-in-class work at Polsinelli,” said Polsinelli Intellectual Property Department Chair Patrick C. Woolley. “Working with tough examiners often leads to double the average prosecution time and lessens the likelihood that the application will succeed by 10 percent, but our team continues to excel and achieve results for our clients.”

Polsinelli succeeds in earning allowances from difficult USPTO examiners and as a result, is included on Juristat’s list of “24 Firms with the Best Track Record Against Difficult Examiners”. To be considered a “difficult examiner,” they must have reviewed 100 or more applications between January 2015 and December 2019 and had an allowance rate of 10 percent or less.

Polsinelli ranks No. 4 on Juristat’s list of “Firms with Most Applications in Front of the Most Difficult Examiners” with 29 applications. At the time of publication, examiners at the USPTO have an average allowance rate of 76 percent. The allowance rate of these examiners deemed as “difficult” range from 1.59 percent to 8.54 percent.

Polsinelli is also nationally ranked on Juristat’s "Top Patent Firms in 2021" list for exceptional performance in the USPTO’s Technology Center 2400: Computer Networks, Multiplex, Cable and Cryptography/Security. This ranking is based on the number of applications filed, allowance rate and average number of office actions before allowance over a 12-month period.

Juristat organizes and structures raw USPTO data to build behavioral models of patent examiners’ past behaviors, allowing attorneys to more accurately predict examiners’ future behavior. Juristat’s statistical modeling capabilities allow its users to visually plot their chance of success in every aspect of the patent application process.
