Woman alleges Equifax included false information on credit report

EAST ST. LOUIS - A woman claims her credit report has been wrongfully affected by false information by Ford Motor Credit Company. 

Delana Robbins filed a federal lawsuit in the U.S. District Court for the Southern District of Illinois against Equifax Information Services, LLC and Ford Motor Credit Company, LLC, alleging violations of the Fair Credit Reporting Act.

According to the lawsuit, Robbins claims that the Ford Motor Credit Company negligently and recklessly disseminated false information pertaining to her credit. In response, Equifax failed to provide reasonable procedures in ensuring the accuracy of credit reports prepared in regards to the plaintiff and failed to investigate credit report inaccuracies in response to her disputes.

In May 2021, Robbins noticed that Equifax was reporting an FMC tradeline on her credit report with a zero balance and a current status of 30-59 days past due, which resulted in her credit score being negatively impacted. Robbins noticed the report contained an inherent contradiction of being marked late while no balances existed, and sent in a letter of dispute. Instead of conducting a reasonable investigation, the defendants wrongfully concluded the accounts were accurate and have continued to report the negative information.

Robbins claims she has been caused to suffer aggravation, humiliation and embarrassment.

Robbins seeks an award for actual damages, plus punitive damages, statutory damages, cost of action and attorney's fees. She is represented by Yitzchak Zelman of Asbury Park, NJ.
