EAST ST. LOUIS - A pension fund claims Roadworks LLC failed to make employee contributions.
Central Laborers’ Pension Fund and Associated General Contractors of Illinois Industry Advancement Fund filed a federal lawsuit on Jan. 25 in the U.S. District Court for the Southern District of Illinois against Roadworks LLC.
According to the lawsuit, Central Laborers’ Pension Fund is a collection agent authorized to act on behalf of other named plaintiffs to collect employer contributions and other amounts owed, including employee benefits plans, labor organizations, labor-management committees, and/or plans established pursuant to collective bargaining agreements between Laborers’ International Union of North America and certain employer associations.
Central Laborers’ Pension Fund claims the defendant did not pay contributions, work dues and wages and fringe benefits to the plaintiffs for the months of October 2018, July 2020, September 2020, and October 2020. By failing to make the contributions, the defendant allegedly breached the provision of the trust agreements and collective bargaining agreements, and is in violation of the Employee Retirement Income Security Act of 1974. The defendant allegedly owes liquidated damages equal to 10 percent of the delinquent contributions.
The plaintiffs seek a judgment for the liquidated damages in the sum of f $1,026.26, plus attorneys’ fees and costs. The plaintiffs are represented by John P. Leahy of Cavanagh & O'Hara LLP in Springfield.
