Cyclist claims brake failure caused crash

EDWARDSVILLE - A woman is suing a bicycle manufacturer and the shop she bought the bike at after the brakes allegedly malfunctioned, causing her to crash. 

Amanda Garcia filed a lawsuit in the Madison County Circuit Court against Giant Bicycle, Inc., The Cyclery and Fitness Center, Inc. and Tektro, alleging negligence, Res Ipsa Loquitur and product liability.

According to the lawsuit, Garcia purchased a new Giant Room II Disc bicycle on May 8, 2020, from The Cyclery and Fitness Center. While riding the bicycle on April 4, 2021, she claims the brakes failed while she was trying to apply them, resulting in her losing control of the bike and crashing.

Garcia claims she was caused to suffer physical pain, emotional suffering, diminished quality of life, lost wages, medical care and treatment expenses, and injuries to her brain, skull, face and mandible. 

Garcia seeks an amount in excessive of $50,000 plus cost of suit. She is represented by John Leskera of Leskera Law Firm in Collinsville.
