EDWARDSVILLE - A Marine couple is suing a construction company for allegedly negligently laying the home's foundation.
Kyle and Allison Martin filed a lawsuit on Dec. 28 in the Madison County Circuit Court against WEC Williams Excavating and Construction, Inc., alleging breach of contract and negligent property damages.
According to the lawsuit, on May 13, 2020, the defendant provided an estimate to lay the foundation and walls of a new home for the plaintiffs for a total of $64,974.50. After providing an estimate, he was hired by the Martins. Construction on the home began Nov. 6, 2020. The Martins claim the job was completed and they paid the total invoice.
The Martins claim they later learned that the foundation size of the house was incorrect, and they would be unable to frame the home. The Martins claim they had to have the basement floor and interior walls raised four inches due to water under the foundation. They were allegedly forced to pay $29,792.00 for the project.
The Martins allege the defendants failed to lay and pour the correct size foundation and failed to backfill dirt along the back foundation after digging the trench for the cylinder blocks, effectively laying and pouring the north wall foundation so that the home was not square. They also claim the defendant installed the culvert in the wrong location and failed to properly lay the garage floor.
The Martins claim they were caused to suffer costs for repairs.
The Martins seek an amount in excess of $50,000. They are represented by Brian R. Kalb of Byron Carlson Petri & Kalb LLC in Edwardsville.
