EDWARDSVILLE - A Glen Carbon woman claims she was injured when a neighbor's dog came onto her property and attacked her.

Penny L. Bettorf filed a lawsuit on Jan. 5 in the Madison County Circuit Court against John Grant III, alleging violation of the Illinois Animal Control Act, violation of county ordinance and negligence.

According to the lawsuit, Grant owned and kept a dog on his premises. Bettorf claims she was on her property in Glen Carbon on June 18, which is near the defendant's residence. She alleges she was walking with her restrained dog, Rosie, when Grant's dog allegedly came onto her property and attempted to attack Bettorf or Rosie. Bettorf claims the incident caused her to fall and sustain injuries.

Specifically, Bettorf claims she was caused to suffer injuries to her arm and hand, which may be severe and permanent. She also claims she endured pain, suffering, disfigurement and emotional distress.

Bettorf seeks an amount in excess of $50,000, attorney's fees and other costs. Bettorf is represented by Warren E. Benning of Wendler & Zinzilieta PC in Edwardsville.
