Grain company sues customer for allegedly failing to make payments

EDWARDSVILLE - A Hamel grain company is suing a business for allegedly opening an account and failing to make payments. 

Hamel Co-Op Grain Company filed a lawsuit on Dec. 23 in the Madison County Circuit Court against Joann Gay doing business as Italia, LTD., alleging charges to be paid on an open account. 

According to the lawsuit, Hamel Co-Op Grain Company has held an open account for the defendant, in which Italia has acquired $62,373.58 in charges at 2 percent a month. These charges within the open account have not been paid by the defendant, the suit states. Hamel Co-Op claims it sent a letter to Italia on Nov. 4, demanding for the full amount to be paid, which was then for $59,910.82. Italia has allegedly not made any attempt to pay down the account, the suit states. 

Hamel Co-Op Grain Company seeks the sum for $59,910.82, plus additional finance charges and cost of suit. Hamel Co-Op Grain Company is represented by Paul H. Lauber in Edwardsville.
