Man sues Doc's Smokehouse over icy slip, fall

EDWARDSVILLE - A man is suing a restaurant after he allegedly slipped on ice and suffered a broken leg. 

Mark Levy filed a lawsuit on Dec. 21 in the Madison County Circuit Court against Plocher Construction Company, Inc., Edwardsville Town Center, LLC., Susan Richardson and Howard Richardson, doing business as Doc's Smokehouse.

According to the lawsuit, Levy and his wife were on the premises of Doc's Smokehouse for dinner on Feb. 26, 2020. As they were leaving the restaurant, Levy allegedly slipped on a patch of ice that had formed under the overhang. 

Levy alleges the defendants negligently designed the overhang above the door so that water diverted directly to the ground below. He also claims they failed to include a downspout or system to collect water and prevent it from turning into ice, causing dangerous conditions for potential harm to customers. 

Levy claims he was caused to suffer a broken left scapula and exacerbation of his pre-existing Parkinson's, pain and suffering, loss of a normal life and medical treatment. 

Levy seeks an excess of $50,000, plus costs of suit. Levy is represented by Jennifer M. Wagner of Golenberg, Heller and Antognoli, P.C. in Edwardsville.
