EDWARDSVILLE - A motorist is being sued after he allegedly caused a collision in Madison while another vehicle was stopped due to traffic conditions.
Demaro Brownlee and Marcella Little-Brownlee, of Springfield, filed separate lawsuits on Dec. 16 in the Madison County Circuit Court against Kendall Kennedy, alleging negligence.
According to the lawsuits, Brownlee was operating a vehicle traveling westbound on Skeen Street near the intersection of McCambridge Avenue in Madison on Dec. 20, 2019. Little-Brownlee was riding in the vehicle as a passenger. Kennedy was traveling in the same direction when he allegedly collided with the plaintiffs' vehicle while they were stopped due to traffic conditions.
The plaintiffs allege Kennedy failed to keep a property look out for traffic, failed to keep his vehicle under proper control, negligently and carelessly collided with the plaintiffs' vehicle, failed to stop or otherwise maneuver his vehicle to avoid a collision, failed to see the plaintiffs, failed to reduce speed, failed to stop in time to avoid a collision, failed to keep a proper distance when traveling behind a vehicle and was otherwise negligent.
Brownlee claims he was caused to suffer severe and permanent injuries internally and externally to his neck, shoulders and upper back. Little-Brownlee claims she suffered injuries to her neck, left shoulder and upper back. They both claim they incurred expenditures of large sums of money for medical, hospital and pharmaceutical expenses, lost wages and damaged future earning capacity.
Brownlee and Little-Brownlee both seek a judgment in excess of $50,000, plus cost of suit. They are represented by Micah S. Summers of Walton Telken LLC in Edwardsville.
