Woman sues over alleged rear-end collision while waiting to make turn

EDWARDSVILLE - A motorist is suing the driver of another vehicle who allegedly caused a rear-end collision while the plaintiff waited to make a left turn. 

Alyssa R. Nichols filed a lawsuit on Dec. 16 in the Madison County Circuit Court against David T. Wells.

According to the lawsuit, Nichols was driving east on U.S. Route 40 and was stopped to make a left turn onto Schlaeffer Road in Troy on Jan. 21. While waiting to make the turn, Wells, who was also driving east on U.S. Route 40, allegedly ran into the rear of the plaintiff's vehicle.

Wells allegedly drove at a speed greater than reasonable and proper, failed to decrease speed to avoid a collision, failed to keep the vehicle under proper control, failed to alter the direction of his vehicle or reduce speed and failed to keep a proper lookout ahead so as to be able to slop.

Nichols claims she was caused to suffer injuries to her head, neck, possible future loss of large sums of money for medical treatment and was prevented from tending to her usual duties and affairs.

Nichols seeks a judgment in excess of $50,000, plus cost of suit. Nichols is represented by Dustin S. Hudson of Neubauer Johnston & Hudson PC in Fairview Heights.
