EDWARDSVILLE -- Multiple healthcare facilities are being sued for allegedly failing to help prevent a resident from falling and then failing to properly assess her injuries after she fell.
Jeffery Bivens, as independent executor of the estate of Lillian Poggemiller, deceased, filed a lawsuit on Dec. 1 in the Madison County Circuit Court against Bravo Care of Alton, Inc., doing business as Rosewood Care Center of Alton, Bravo Nursing Home Services, Inc., Bravo Holding Company, Inc., Alton NH, LLC., Greystone Healthcare Management-Midwest, LLC., Molly J. Hausman, LPN, and Stannika N. Morgan, LPN.
According to the lawsuit, Poggemiller was a resident in a long-term residential care facility known as Alton NH for multiple stays between November 2019 and April 2020. Poggemiller was a fall-risk patient with no fall risk plan implemented, the suit states. Bivens claims that on more than one occasion, Poggemiller fell during her stay at the facility, but no fall risk plan was ever implemented. He also claims her bed and other items were not fitted with alarms to notify staff of when she would fall. Poggemiller began to complain of pain in her left shoulder that allegedly was not thoroughly evaluated. As time went on, Poggemiller began complaining of pain in other areas, and was even found to have externally rotated her left leg and suffered a hip fracture. It was noted in her chart that she suffered continued weight loss, an infection and other issues.
Bivens alleges the health care facility failed to prevent Poggemiller from falling, failed to timely transfer Poggemiller to an acute care facility, failed to recognize medical conditions, failed to monitor and access Poggemiller accurately, failed to follow physicians' orders and ultimately caused her untimely death. the suit states.
Bivens seeks judgment against the defendants and compensation for injuries, losses and damages. He is represented by Eva E. Golabek of Kralovec, Jambois & Schwartz in Chicago.
