EDWARDSVILLE -- A passenger is suing another driver for allegedly turning in front of the vehicle he was riding in and causing a crash.
Johnnie Yarbrough filed a lawsuit on Dec. 1 in the Madison County Circuit Court against Melissa Masiero, alleging personal injury.
According to the lawsuit, Yarbrough was riding as a passenger in a car owned, operated and controlled by Richard Stewart in East Alton on March 27. Stewart was driving westbound on East Broadway while Masiero was driving eastbound on the same road. Masiero allegedly made a left turn in from of Stewart's car, causing the two vehicles to collide.
Yarbrough alleges Masiero failed to yield to oncoming traffic, failed to keep a proper lookout, drove a vehicle while she was distracted, failed to yield to right-of-way, drove faster than the posted speed limit, failed to reduce speed to avoid a crash and failed to maneuver to avoid a crash.
Yarbrough claims he was caused to suffer physical injury to his neck, back and other parts of his body and endured pain and suffering, loss of normal life and mental anguish.
Yarbrough seeks a judgment in an amount in excess of $50,000, plus cost of suit. He is represented by Michael P. Glisson of Williamson Webster Falb & Glisson in Alton.
