Wrongful death suit alleges nursing home resident died after falling

EDWARDSVILLE - A Godfrey nursing home is accused of providing negligent care to a patient that died shortly after falling. 

Barbara Deck, as personal representative of the estate of Charles P. Woodward, deceased, filed a lawsuit on Nov. 29 in the Madison County Circuit Court against SNH Al TRS, Inc. doing business as Morningside of Godfrey, FVE Managers, Inc., Jonna Parker and Heather Durham, alleging claims under the survival act and wrongful death act.

According to the complaint, Barbara Deck is the daughter of Charles P. Woodward. Due to failing health, Woodward was placed in Morningside of Godfrey, an assisted living facility, in 2019. During Woodward's time at the assisted living facility, he allegedly experienced a fall. Deck claims the staff failed to update Woodward's chart, indicating he was a fall risk. 

Deck also claims the staff returned an empty pillbox to be filled with Woodwards prescription, but the box belonged to a different resident.

Then on Nov. 28, 2019, Woodward fell and suffered a right intertrochanteric hip fracture and died on Dec. 20, 2019, due to his injuries. 

Deck claims Woodward was caused to suffer loss of companionship, comfort, guidance and support. She also claims she incurred funeral and burial expenses. 

Deck seeks a judgement for a sum in excess of $50,000, plus cost of suit. She is represented by Daniel W. Farroll of Goldenberg Heller & Antognoli PC in Edwardsville.
