Edwardsville homeowners sue landscaping company over incomplete patio

EDWARDSVILLE -- Edwardsville homeowners are suing a landscaping company for allegedly failing to complete a patio job and leaving the abandoned project in an unsafe condition. 

Nelson and Adele Metz filed a lawsuit on Nov. 29 in the Madison County Circuit Court against Clear View Landscape, LLC, alleging breach of contract and negligence.

According to the complaint, the plaintiffs entered into a verbal contract with Clear View Landscape on March 12. Under the contract, the defendant agreed to provide services that included materials and labor, the removal of an existing patio and the proper installation of a new patio in exchange for payment. 

The plaintiffs allegedly made an advance payment of half the cost of the job. Believing the defendant would complete the job in the time agreed upon, the plaintiffs later paid the other half of the sum for the job to be completed. However, they claim the defendant did not complete the job and failed to return the final payment. 

Nelson Metz claims he attempted to finish the patio, which resulted in him tripping and falling due to the unsafe conditions of the abandoned project.

The plaintiffs claim they were caused to suffer dangerous conditions, minimal industry standards of the construct of the patio, an incomplete patio job. Nelson Metz claims he endured pain and suffering as a result of his injury.

The plaintiffs seek an amount in excess of $50,000. They are represented by Brian W. Burge of MeyerJensen PC in Alton.
