BELLEVILLE - A motorist and passenger claim they were injured in a rear end collision at an intersection in Freeburg.
Katrina Fenner and Noah Williams filed a lawsuit on Nov. 30 in the St. Clair County Circuit Court against Emily Midden.
According to the complaint, Fenner was driving a 2015 Chrystler 200 with Williams as a passenger on Jan. 23, 2020. Midden was driving a 2013 Kia Soul when she allegedly rear-ended Fenner and Williams as the plaintiffs were stopped on North State Street near its intersection with Oak Brook Drive in Freeburg.
The plaintiffs claim Midden negligently and carelessly failed to operate a vehicle in a safe and proper manner, failed to keep proper lookout, failed to keep a vehicle under control as to avoid a collision, failed to use every precaution to avoid a collision, proceeded at a speed greater than reasonable and failed to decrease speed, stop or swerve to avoid a collision.
Fenner and Williams claim they were caused to suffer severe and permanent injury, disability and disfigurement, became liable for hospital, medical and other health care expenses. They also claim they suffered great physical pain and mental anguish.
Fenner and Williams seek an amount in excess of $100,000. They are represented by John Hipskind of Hipskind and Mcaninch, LLC of Belleville.
