EDWARDSVILLE - A trucker claims the DriveCam technology violates the Illinois Biometric Information Privacy Act (BIPA) by collecing facial geometry.
Joshua Lewis filed a class action on Nov. 17 in the Madison County Circuit Court against Maverick Transportation LLC and Lytx, Inc., alleging violation of 740 ILCS.
According to the complaint, Maveric Transportation LLC is a transportation and logistic corporation and Lytx, Inc. is a video telematics and fleet management systems corporation. In 2020, Maverick allegedly began implementing its MV+AI-enabled DriveCam in all trucks, which also collected face geometry.
Lewis alleges Lytx's technology is employed in more than 4,000 fleets throughout the country. He claims that by collecting data of drivers' facial geometry and biometrics, both companies are in violation of BIPA as this is taken of drivers' without driver consent.
He accuses the defendants of failing to develop written retention schedules and destructive guidelines, failing to obtain informed written consent and release before obtaining biometrics and selling, leasing, trading or profiting from the biometrics.
Lewis seeks a declaration of Maverick Transportation LLC and Lytx, Inc. in violation of BIPA, plus injunctive and other equitable relief, statutory damages of $5,000 for each violation of BIPA or $1,000 for each negligent violation, attorneys' fees and cost of suit.
