Motorcyclist injured in crash sues over denied disability insurance claim

EAST ST. LOUIS — A man who became disabled after a motorcycle crash is suing his insurer for allegedly denying of his disability benefits coverage. 

Terry Roundcount filed a complaint Nov. 12 in the U.S. District Court for the Southern District of Illinois against Lincoln National Life Insurance Company, alleging violation of the Employee Retirement Income Security Act (ERISA). 

According to the complaint, Roundcount is a vested participant in the long-term disability plan for certain employees of Growth Market Inc.,/Tri County FS Inc., with Lincoln National providing coverage under the plan. He alleges that in August 2017, he was involved in a motorcycle crash and suffered permanent injuries, including fractures and a head injury. He alleges his injuries have caused him to become disabled.

Roundcount claims Lincoln paid him benefits up through July 2, 2020, and then determined his benefits would be denied despite his being unable to return to his full-time occupation and having medical records to prove his disability. Roundcount also alleges Lincoln failed to hire an independent vocational counselor or physician to perform evaluations on his condition in violation of ERISA. 

The plaintiff also alleges Lincoln denied appeals he made in March and July of 2021. 

Roundcount seeks monetary relief, trial by jury and all other just relief. He is represented by Matthew Padberg and Nicole Burlison Knepper of Padberg, Corrigan & Applebaum in St. Louis.
