Cryptocurrency exchange accused of collecting biometric data without consent

BELLEVILLE — The world's largest Cryptocurrency exchange company, Binance, is facing a class action alleging it illegally collected users' biometric data. 

Kamil Kuklineski, individually and on behalf of all other similarly situated filed a complaint Oct. 4 in the St. Clair County Circuit Court against Binance Capital Management Co., doing business as Binance BAM Trading Services, doing business as Binance.US, and Jumio Corporation, alleging violation of the Illinois Biometric Information Privacy Act and unjust enrichment.

According to the complaint, Binance and Jumio partnered to verify the identities of users on its exchange. Jumio also partnered with Binance to use its technology within the Binance.US mobile application. The plaintiff alleges he downloaded the Binance.US iPhone app and created an account. In doing so, he claims he was required to enter personal information and take a photograph of his driver's license and of his face. 

Kuklineski claims users are not given advance notice that their biometric data would be collected and that he was not given a written release for the collection of his biometric data. The plaintiff also claims the defendants failed to give written disclosures on the data retention or destroying of the data in violation of the Illinois Biometric Information Privacy Act. 

The plaintiff seeks monetary relief, trial by jury and all other just relief. He is represented by Joel Beckwith of Freeark, Dennis, Murphy & Moskop PC in Belleville.
