Dump truck driver allegedly blocked lanes on I-70, causing fatal crash

EDWARDSVILLE — A hauling company and its dump truck driver are facing a wrongful death claim after a driver was killed on Interstate 70.

Amanda Ross, as special administrator of the Estate of Riley Schreck, deceased filed a complaint Oct 14 in the Madison County Circuit Court against Bryan Paskero, B.P. Hauling Inc., and the Killian Corporation, alleging wrongful death. 

According to the complaint, Schreck was driving her Volkswagen Jetta on Interstate 70 at the I-55/270 interchange near Troy on Sept. 25. The plaintiff alleges that Paskero was operating a Mack dump truck on Interstate 70 in a construction zone, pulled the truck across the entirety of the westbound lanes of the interstate and blocked the lanes, which caused Schreck to collide with the truck. The suit states that Schreck was killed when her vehicle collided with the dump truck. 

The plaintiff alleges Paskero negligently blockedtraffic with the Mack truck and created a hazard. Ross also alleges the defendant failed to keep a proper lookout for traffic, failed to take evasive action to avoid the collision and failed to disregard instructions pulling the truck across the lanes on the interstate. 

The plaintiff seeks compensation of more than $50,000 and all other proper relief. He is represented by Thomas Lech and Jennifer Wagner of Goldenberg Heller & Antognoli PC in Edwardsville.
